Employment of foreigners in Poland
[Warsaw, 06.06.2006] Pursuant
to Article 87 of the Law of 20 April 2004 on Promotion of
Employment
and Other Institutions of Labour Market, a foreigner may
perform work in the Republic of Poland if he/she holds a
work permit issued by a voivod competent for the registered
office of the employer.
The work permit is required
if the foreigner:
1) performs work in an entity
having its registered office in the Republic of Poland;
2) performs work at a foreign employer and is seconded to work
in the Republic of Poland in order to perform an export service;
3) performs work at a foreign employer and is seconded to work
at an entity having its registered office in the Republic of
Poland for a period exceeding 30 days in a year in order to
perform tasks specified by the seconding employer, other than
performance of an export service.
It is worth noting that according
to Polish law performance of work by a foreigner means employment,
performance of other remunerative work or performance of functions
on management boards of corporate persons who have been entered
in the register of entrepreneurs on the basis of regulations
on Polish Business Register or are capital companies in organisation.
The term "employment" is understood as performance
of work on the basis of an employment relationship, duty relationship
or a contract on work at home using materials entrusted by
the orderor.
The obligation to obtain the
work permit does not apply to certain group of foreigners,
including refugees, persons holding permits for settling down,
and, first of all, citizens of the EU Member States and citizens
of States with whom the European Union entered into agreements
on freedom of movement of persons (however, this exception
is further restricted).
Before undertaking work in
Poland, a foreigner should consult a local entity having knowledge
required to determine whether the work permit is required in
a given case or not.
